Merchandise Pricing & Availability

Prices and availability for products on Musician’s Friend are subject to change without notice. Products are sold on a first-come, first-served basis. Errors will be corrected when discovered and Musician’s Friend reserves the right to revoke any orders found to be based on pricing or other errors.

Ordering, Payment & Shipping

You agree to pay the prices displayed at the time you submit your order. Applicable sales tax will be added automatically at checkout. We accept Visa, MasterCard, American Express, and Discover credit cards for online orders.

Customers are responsible for ensuring packages have a valid physical address for delivery. Address correction fees may apply if an order is returned or requires redirection. We reserve the right to cancel orders due to unavailable inventory or other issues.

Shipping and delivery dates are estimates only and are not guaranteed. We are not liable for any delays in shipment or delivery. Custom-ordered items may have extended lead times which will be displayed during the ordering process.

Returns & Refunds

If you are dissatisfied with your purchase for any reason, most items may be returned for a full refund or exchange within 45 days of the original purchase date. Custom-ordered items are generally not eligible for return or refund.

To be eligible for a return, items must be in original purchase condition with all accessories, materials, and packaging. We reserve the right to refuse returns or exchanges for heavily worn, damaged, or missing components. Return shipping costs are nonrefundable unless due to Musician’s Friend error.

Refunds are generally processed within 7-10 business days after receiving the return and issued to the original payment method.

Intellectual Property Rights

The Services and all materials therein or transferred, including software, images, text, graphics, logos, videos, music, and sound (collectively, “Content”) and the trademarks, service marks, and logos contained therein (“Marks”), are owned by or licensed to Musician’s Friend and subject to copyright and other intellectual property rights under the law.

Content is provided to you only for your personal, non-commercial use. You may not modify, copy, distribute, transmit, perform, display, publish, license, frame, create derivative works from, transfer, or otherwise use in any other way for commercial or public purposes any Content obtained from the Services without our express prior written permission.

User Content & Behavior

You retain ownership of any content you submit, post, display or otherwise make available (“User Content”) on or through the Services. By sharing User Content through the Services, you grant Musician’s Friend a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to reproduce, adapt, modify, translate, distribute, publicly perform, and publicly display your User Content through the Services.

You agree not to provide User Content that is illegal, abusive, threatening, libelous, defamatory, obscene, vulgar, offensive, pornographic, profane, sexually explicit, racially or ethnically offensive, factually inaccurate, infringing of intellectual property rights, invasive of privacy, promotes violence, promotes discrimination, or is otherwise objectionable to Musician’s Friend.

We reserve the right but not the responsibility to monitor disputes between you and other users and to restrict, suspend, discontinue, or edit your access to the Services or User Content at any time for any reason without notice.

Indemnification

You agree to defend, hold harmless, and indemnify Musician’s Friend from any actual or threatened claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (i) your breach of these Conditions of Use; (ii) your misuse of the Services; or (iii) User Content you submit, post to, or transmit through the Services. We reserve the right to exclusively defend and control any such actions at your sole expense.

THE SERVICES AND CONTENT ARE PROVIDED “AS-IS” WITH NO WARRANTIES. WE EXPRESSLY DISCLAIM ANY WARRANTIES AND CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, DURABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT GUARANTEE THE ACCURACY, INTEGRITY, QUALITY, OR CURRENCY OF ANY CONTENT. USER CONTENT IS PROVIDED BY AND IS SOLELY THE RESPONSIBILITY OF THE PERSON OR ENTITY FROM WHOM THE CONTENT ORIGINATED. WE ARE NOT RESPONSIBLE FOR DAMAGES CAUSED BY YOUR RELIANCE ON INACCURATE OR DECEPTIVE USER CONTENT.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR CERTAIN DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. You agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within San Francisco County, California for resolution of any dispute, action, or proceeding arising out of or relating to these Terms or your use of the Services.
